Landlord & Tenant

It is important to get advice before entering into a tenancy agreement to ensure that you fully understand the extent of any legal obligations imposed upon you and what you can expect of the other party to the agreement. We will be happy to speak to both Landlords and Tenants who may wish to have a solicitor draw up a tenancy agreement or simply want to discuss an existing agreement.

We also provide assistance to Landlords in drawing up legal notices that are required before possession proceedings can be started. We can advise Landlords about the remedies available to them for obtaining possession.

We can also advise Tenants about whether the Landlord has complied with the appropriate notice procedure and whether there is any defence to a possession claim.

Clients should remember that it is unlawful to remove a tenant from a property without a court order and damages for unlawful eviction can result if a party is in default of the appropriate legal procedures. Please note that the position of lodgers and licencees may differ and advice should be sought where there is likely to be any dispute as to the facts.

We are happy to draft Commercial Tenancies and to advise on the renewal of such tenancies under Part II of the Landlord & Tenant Act 1954.
